Recent reports from “Asia News” highlight a significant development in the toy industry as a U.S. judge rejects Alibaba’s attempt to dismiss a lawsuit. The lawsuit revolves around various merchants accused of selling counterfeit versions of the widely popular children’s toy, Squishmallows, on Alibaba’s online platforms.

Jazwares, the parent company of Kelly Toys, filed the lawsuit against Alibaba, alleging that the e-commerce giant allowed third-party merchants to sell fake Squishmallows. Alibaba contended that Kelly Toys failed to provide evidence of infringement and sought to have the case dismissed. However, the judge ruled in favor of Kelly Toys, determining that Alibaba must face the legal proceedings.

In November 2022, Kelly Toys took legal action against approximately 90 merchants for selling counterfeit Squishmallows and secured an injunction two months later. Alibaba was later added as a defendant in March of the following year.

Alibaba’s previous explanation emphasized that Kelly Toys did not specifically accuse them of engaging in any infringing activities. The e-commerce giant argued against the alleged infringement, attempting to shift the burden of intellectual property oversight to the sellers by deeming Kelly Toys’ proposed measures as “draconian.”
